Parental leave rules

Please note

  • Paid leave must be held before unpaid leave. The order is therefore: leave with salary, leave with benefits and leave without income.
  • After the deadline has passed for submission of form No. 2 it is not possible to change the information in the form.
  • Please count in full weeks (7 days). If a period contains weekends or public holidays those days count as leave too.

Salary and parental benefits

The right to salary in accordance with the Danish State's Agreement on Maternity, Paternity, Adoption and Parental Leave (the parental leave agreement) is conditional on the employer being able to obtain a full daily benefit refund.


Employment requirement according to the Consolidation Act on the Right to Leave and Parental Benefits (the Parental Leave Act):

Section 27. An employee is entitled to parental benefits from Udbetaling Danmark when the individual:

  1. on the day before the absence or on the first day of absence is employed and has been employed for at least 160 hours, cf. subsection 2, within the last 4 completed calendar months prior to the period of absence, and during at least 3 of those months has been employed for at least 40 hours each month,

  2. would have been entitled to unemployment benefits or a benefit substituting such, cf. the Act on Unemployment Insurance, if there were no entitlement to benefits under this Act,

  3. within the past month has completed a vocational education program of at least 18 months' duration.


In accordance with the Collective agreement for academics employed by the state, your employment will continue throughout the entire leave period, although it expires during the leave. Furthermore, your PhD fellowship will be extended by the part of the leave period that falls within the fellowship period.

  • Holiday year ends during leave
    If you have been prevented from taking holiday for a recognised reason, e.g. illness, maternity/paternity leave or adoption, which has lasted until expiry of the holiday period on 31 December, the first four holiday weeks will automatically be carried forward to the next holiday period.
